PUBLIC DOMAIN CHARACTERS: A USER'S GUIDE -- YOU CAN TRY... BUT SHOULD YOU?

by Frank Schildiner

One of the running themes in the discussion of public domain characters are the technicalities about public domain versus trademark. This is a surprisingly hot button issue for some people, so I will try and explain why the argument is, in my opinion and experience, fairly silly.

There are characters whose stories have fallen into the public domain. This has led some to believe that the characters are openly available to free use. Sorry, this stuff, like life itself, is not that simplistic. Let's walk through an example.

One of my favorite heroes is the original Nick Carter. I’m not interested in his secret agent days and have limited enjoyment of his private eye days. No, my enjoyment is from his earliest days, when Nick was a heroic dime novel detective in the late nineteenth century. Over the years I read many of these stories and found the character among the best adventure protagonists of an interesting era.

With this in mind, I can tell you that his original stories are public domain. They fall well into the legal definition. So, does that mean I can write him free and sell my own Nick Carter tales?

Nope, nyet, non, and a big heck no. What the above means is that if I find a copy of one of his early adventures in the original form, not someone else’s reprint, I can reproduce that story exactly. The story is completely available for sale if I reprint it, but that is where my part ends.

You see Nick Carter, in all his forms, is a trademarked character owned completely by Condé Nast. There are elements of the character they specifically own and you may not use them under any circumstances. To do so will result in swift action by said company starting with a cease and desist letter and followed by a threat of a lawsuit.

Trademarks are less powerful bindings as creative rights, but they do exist. They are the power many big corporations like Disney plan on invoking in the future.

Now we come to the title of this essay… You can try, but should you? Many people who read the above will protest that you, as the fiction writer, can fight for the right to use the character. This occurred when people filed lawsuits fighting for the right to use Sherlock Holmes. This court battle was an interesting one that dragged on for several years.

The result was that much of the World’s Greatest Detective was declared public domain and therefore free to use, even regardless of trademark claims. Certain elements were still held by the Conan Doyle estate, but the majority is open to the public. This was a landmark decision, one in which I benefited recently.

However, we return to the question… You can try, but should you? You do have the right to fight for characters whose stories may or may not fall into the public domain, but is it worth your efforts? Remember that in many of these cases, your character’s trademark rights are held by a big company like Condé Nast. These people have the lawyers and resources to fight for their rights as well as the time to drag out their efforts in the courts.

Now, if you are someone whose bank account can afford the time, cost, and efforts that would go into a lawsuit over a character, you can go for it any time. In the case of Sherlock Holmes, the character is one of the most popular and beloved worldwide. The market was already present even if the win wasn’t assured at the start of the fight. While I adore Nick Carter, the fight would cost me and pretty much anyone else more than the character’s worth.

This now comes full circle. While a trademark is not as strong or as legally powerful as creative rights, the effort in fighting for your chose piece of fiction may be a climb as unobtainable as a proverbial Mt. Everest. While the climb is possible for some, the cost may be more than most bodies can bear.

Submissions Requests: SHERLOCK HOLMES AND THE OCCULT DETECTIVES III

After the success of Sherlock Holmes & the Occult Detectives Volumes I and II (Belanger Books, 2020), we are back, dear listener, to announce that we are now open to story pitches for a new anthology, Sherlock Holmes and the Occult Detectives III! So do read on for everything you need to know…

THE BACKGROUND

Last year I had the pleasure of editing the two anthologies mentioned at the start, in which we presented almost 200,000 words of brand new stories from a host of contemporary writers, all based on the possibility that Sherlock Holmes chose, or had of necessity, to work with those figures of the time who called themselves occult detectives, psychic investigators and the like.

Sherlock Holmes and the Occult Detectives III

Sherlock Holmes and the Occult Detectives III will once again be about detection, logic and mysteries. It will concern an authentic Sherlock Holmes, but with the same simple twist:

Perhaps Holmes is already privately aware that there may be supernatural elements in the world, but has tried to close off such thoughts, finding them too illogical. Or perhaps he is disturbed to find something quite inexplicable affecting his resolution of a particular case, and has to step beyond his normal boundaries. He may, of course, still be highly sceptical.

And maybe Dr Watson was never allowed to include any such explicit references when he wrote up his friend’s adventures, but now these instances can be brought into the light.

Does this ruin the core of Holmes’s original position? Not necessarily, for as we have oft said, Holmes’s most quoted comments on the supernatural are not quite as definitive as some might believe. Do you remember ‘The Sussex Vampire’? That particular Conan Doyle tale contains the famous lines, where Holmes tells Watson:

“This agency stands flat-footed upon the ground, and there it must remain. The world is big enough for us. No ghosts need apply.”

In ‘The Hound of the Baskervilles’, what he states is that normal investigative techniques and logical deduction would be of no use in supernatural cases.

“If Dr. Mortimer’s surmise should be correct, and we are dealing with forces outside the ordinary laws of Nature, there is an end of our investigation. But we are bound to exhaust all other hypotheses before falling back upon this one.”

We could therefore say Holmes’s concern is that none of his peculiar intellectual talents can be of value in a situation where normal ratiocination is overthrown. He has dismissed that which will not yield to him.

If there are such cases, genuine ones, who will take them on? More foolish, credulous or cash-hungry ‘consulting’ detectives? Fraudulent psychics? Or, now and then, the true occult detectives, those who have developed a different blend of investigative skills and knowledge of matters apparently ‘outside the ordinary laws of Nature’…

Will they come to him for advice, will they cross his path during a case, or will he, however reluctantly, turn to them when only the impossible can explain what has happened…?

You may be able to tell us.

[Link] THE MYSTERY IS HOLMES: WHY WE RETURN TO CONAN DOYLE'S STORIES OVER AND OVER AGAIN

By Timothy Miller

What’s a mystery all about? The ending? Well, of course, you say—the denouement, the unraveling of the clues, the big reveal. If it’s too easy to guess the ending before that very moment, or if the ending doesn’t seem to mesh with the clues provided by the author you’re disappointed with it. It’s a lousy mystery, right?

Really? Ever re-read a mystery? Even though you know the solution? (If you’re like me, of course, you can re-read it a year later because you’ve forgotten the solution, but that’s another matter.) But what’s the pleasure in re-reading if the entire pleasure is in the solution dangled like a carrot before you? Tom Stoppard, the great British playwright, opines that a play which depends on keeping its secrets isn’t worth viewing twice—which he found out the hard way. Which brings us to the mystery of Sherlock Holmes. If you’ve read a Holmes story, chances are you’ve read another, and if you’ve read two, you’ve probably read them all and re-read them all, and chances are you’ve picked every bone of that corpus clean, with a great deal of relish. Why on earth would you do that? Where’s the mystery in that? I’ll spill my solution up front: the mystery is in Holmes. It’s been said that next to Jesus and Hamlet,  Sherlock Holmes has had more ink spilled about him than any man, real or fictional. Holmes is the black box of literature. Doyle’s genius is not in what he reveals, but what he conceals. The rue depth is not in the notes, but the silences.

SHERLOCK HOLMES: THE MISSING YEARS

Airship 27 Productions is proud to present the 10th Volume in its best-selling mystery anthology series, Sherlock Holmes – Consulting Detective.

According to the stories of Sir Arthur Conan Doyle, Sherlock Holmes, while battling his arch foe, Prof. Moriarty, was lost in the Falls at Reichenback and presumed dead, though his body was never recovered. Upon his return to London four years later, Holmes informs Dr. Watson that he had been traveling Europe and the Far East under the disguise of a Norwegian named Sigerson. Now, in a novella-length adventure, I.A. Watson delves deeper into those missing years, revealing who it was that accompanied the Great Detective during those missing years.

This is one of four brand new stories that fill this 10th volume of Airship 27 Productions’ best selling series. Writers Aaron Smith and Greg Hatcher offer up their own unique tales; among these a clever burglar who robs from the rich while they attend a theater performance and in another, Holmes and Watson come to the aid of former Baker Street Irregular accused of murder.

“I’d like to believe the reason this series is so popular with our readers is because we are devoted to only doing Conan Doyle style mysteries,” says Airship 27 Productions’ Managing Editor, Ron Fortier. “Over the years there have been lots of wild and crazy Sherlock Holmes stories pitting him against all manner of fanciful monsters, aliens and who knows what else. Whereas loyal Holmes fans, for the most part, cherish the old style adventures as Doyle wrote them; a mystery with all the clues narrated by Dr. Watson and in the finale solved by the Great Detective. This is what our readers want and this is what we are dedicated to bringing them. Old fashion tales.”

Once again three of the finest New Pulp writers breathe life into Conan Doyle’s classic characters and spin exciting, suspenseful tales of mystery and intrigue. As ever award-winning Art Director Rob Davis provides the beautiful interior illustrations and Graham Hill delivers a truly marvelous cover painting of Holmes at rest in his 221 B sanctum. So, dear readers, sit back, pour yourselves a brandy and prepare to enjoy a truly wonderful collection of stories starring the one and only Sherlock Holmes – Consulting Detective.

Airship 27 Productions is thrilled to announce the release of “Sherlock Holmes – Consulting Detective Vol 9.”

Once again, hidden on the fog shrouded streets of London are heinous criminals set upon their nefarious schemes. All that stands in their way are two men, stalwart and unafraid to take on villainy in all its insidious disguises; Sherlock Holmes and Dr. Watson.

“Every single time we put out a new volume, our Sherlock Holmes fans are delighted,” says Airship 27 Production’s Managing Editor, Ron Fortier.  “Honestly, they devour each one and then within weeks of a new release, I’m getting mail asking when the next one is coming out. The popularity of these characters appears to be as strong as ever to readers around the world.”

In this, the ninth entry in this bestselling series, the crime solving companions tackle five brand new mysteries that are totally unique from any of their previous adventures. Among these; an entire crew of a shoreline light house vanishes during a raging storm, one of Watson’s old army colleagues is accused of murder and a former Baker Street Irregular seeks out their aid on behalf of his crippled father. These three cases and two others are brilliantly delivered by writers I.A. Watson, Fred Adams Jr., Erik Franklin and Aaron Smith. Proving once again there is only one Sherlock Holmes, Consulting Detective.

Airship 27 Productions’ Art Director, Rob Davis provides the black and white interior illustrations as he has done with all previous volumes and Adam Shaw delivers a truly striking cover.  Sure to be another winner from the leading publisher in New Pulp fiction.

GEORGE KUCH TO READ “HOLMES & HOUDINI”

Airship 27 Productions, in association with Radio Archives, is thrilled to announce that veteran voice actor George Kuch will be reading “Holmes & Houdini” by author, I.A. Watson.  A veteran of 30 years theater experience, Kuch joined the AFTRA union around 2008 and did much background and stand-in work for TV shows filmed in the New York/New Jersey area.

Although steady work, there was little for the actor in creative satisfaction. He was looking for something in which he could utilize his acting skills. Thus he attended an AFTRA seminar on audiobook narration and was immediately intrigued by the possibilities inherent in such work.  “I would be able to act all the roles in a story,” he recalls vividly. “Success would be determined by my ability to tell a story alone using the experiences and knowledge I’d gained from the stage in a completely new direction.”

Kuch sought out advice from professional audiobook narrators and was subsequently coached by Paul Alan Rueben, one of the finest directors of audiobooks. Thus prepared, he launched his new career in 2011 and has since narrated over 100 audiobooks.

Being a long time fan of Sherlock Holmes, Kuch was thrilled when the opportunity arose to narrate new Holmes adventures for both Pro Se Press & Airship 27 Productions.  “I was asked if I had any interest in narrating some of the Sherlock Holmes anthologies and I jumped at the chance. I have now completed 8 anthologies and 4 stand-alone Holmes novels with still more to be done.”

“Our readers love George’s readings,” says Airship 27 Productions’ Managing Editor Ron Fortier. “Whereas I.A. Watson’s novel was a special project, teaming the Great Detective with famous magician Harry Houdini. Knowing that it this book is now in George’s capable hands, tells me this is going to be one fantastic audiobook our fans will not want to miss.”

All Airship 27 titles are produced via Radio Archives and sold at Amazon on the same pages as the books and kindle versions. Further announcements will be made when the audibook is officially on sale.

The Club has recruited an army of killers in their maddened goal to destroy Houdini. But they are unaware he is not without his own allies.   Joining the fray at the American’s side is none other than the great detective of Baker St, Sherlock Holmes, and his loyal companion, Dr. Watson.   Together these exceptional heroes will battle an insidious evil and attempt to solve the mystery of the Ghost Mask of L’Inconnu.

“We’ve been waiting almost an entire year to get this out,” says Airship 27 Productions Managing Editor Ron Fortier.   “15 copies of a limited edition collectors edition sold out on the first day at this year’s PulpFest in Columbus, Ohio. Submissions Sought for 12-part Sherlock Holmes Novella Series

While Sir Arthur Conan Doyle left this earthly realm on July 7, 1930, his character of Sherlock Holmes has never been more alive.  Through the current films and TV shows starring the great detective, his popularity only increases.  Publishers such as Gasogene Books and MX Publishing focus mainly on new books about the great detective, and many more presses have at least one new Sherlock Holmes book in their catalogues.  Now another publisher has an opportunity for pastiche writers to compose new tales for the Sherlock Holmes canon.

Authors Needed

18thWall Publishing is creating a 12 part Sherlock Holmes novella series called The Science of Deduction that will be released in 2016.  One title will be released each month that year, and then in December, all 12 novellas will be bundled into a complete anthology. The stories themselves must be novellas of 15,000 - 30,000 words in length, with the author's voice and narrative style coming through.

"People rarely realize how short the Sherlock Holmes novels are," explained James Bojaciuk,  CEO Duobus of 18thWall.

"A Study in Scarlet and The Valley of Fear are short novellas (padded out by long memories of the United States), and The Sign of the Four is a longish one. Only The Hound of the Baskervilles is, as they say, feature length -- but even then it is very short indeed. Yet when I look at my Sherlock Holmes shelves, it is overwhelmed with three-, four-hundred page novels and dozens of short story collections. I'd like to reclaim the novella form for Sherlock Holmes, which, personally, I think is the best length for his adventures."

Authors seeking to submit a story for the series should note that submissions may be traditional or can feature a Holmes of an alternative universe. "We're especially keen on well-researched alternate history," said Mr. Bojaciuk. "All the more so if this alternate history is in the vein of Kelly Hale's "Black Alice" (which reimagines Holmes and Watson as Enlightenment Era gentlemen modeled on Samuel Johnson and his own Boswell), or Michael Kurland's "Four Hundred Slaves" (which examines what Holmes and his biographer would have been like if they were Roman citizens)."

Some Rules Apply

While writers have freedom to explore a unique take on Sherlock Holmes, there are some strict ground rules.  There can be no erotica, no parodies, and no tales which disrespect the great detective in anyway.  As stated on the 18thWall website, "please keep the characters as close to their canonical counterparts as possible. Sherlock Holmes is not a werewolf; Watson did not murder his wife; Mycroft is not Moriarty’s lieutenant; Professor Moriarty is not a tulpa. This stance on canonicity extends through political opinions, sexuality, biography, and characterization. You can work outside these bounds, but do note that this may or may not be a harder sell to the editor."

Submissions are due to 18thWall Publishing by November 1st, 2015.  For more information, please see the 18thWall website.  Authors retain full rights to their characters and stories. And for those of you stuck on where to start a Sherlock Holmes pastiche, Mr. Bojaciuk  did say, "While not outré at all, I'd love to see war stories (particularly in the First World War) with Holmes and Watson."

Story submissions can be sent to submissions@18thwall.com.  Happy writing!

Stephanie Osborn: Hitting the Ideas (Back)

Stephanie Osborn is a regular here at the blog, particularly for the roundtables, but it's only fair to devote a little time to her all by herself.

Tell us a bit about your latest work.

Which one?! I have 3 books actively being written at the moment, in 3 different series; at least 3-4 more are on the back burner!

The one I’m trying to focus on is a book for a publisher new to me. Pro Se Press contracted me to write a Victorian-period Sherlock Holmes novel – hopefully a series. The editor in chief turns out to be a fan of my Displaced Detective series, and as they were venturing into Holmesian territory, wanted to bring me aboard with it. We’re calling the series Sherlock Holmes: Gentleman Aegis. Aegis is the Greek word for “shield,” and I liked invoking a kind of dual meaning: Holmes is a gentleman, but he’s also a shield FOR gentlemen (and -women) against the forces of evil. The first book, on which I’m actively writing, is Sherlock Holmes and the Mummy’s Curse. Be forewarned: it isn’t going to go in the direction you’d think!

What are the themes and subjects you tend to revisit in your work?

Oh, I think in the main, the usual themes: good versus evil, the importance of communication, staying true to oneself. That sort of thing. Parallelism is another one that’s particularly big in my Displaced Detective series.

What would be your dream project?

I have a couple books that I really want to work on, but that both require a TON of research to do right, and consequently they intimidate the *bleep* outta me. One is an epic miniseries about Atlantis, and the other is the story of Jesus’ life — told from a Jewish perspective. But since I’m not Jewish, that’s not nearly as easy as it sounds. And since my intent would be to tie Atlantis in to a bunch of other ancient civilizations, some of which we’re only just getting information on, it means digging deep into all kinds of archaeological research. It’s overwhelming, and I don’t even know where to start.

If you have any former project to do over to make it better, which one would it be, and what would you do?

I think I’d go back and tidy up Burnout a bit more. I look at it, and I look at my more recent books, and I see how much I’ve grown as a writer, and I think how crude Burnout looks — at least to me — by comparison.

What inspires you to write?

Ideas. That’s the best answer I know to give. When the right idea hits, I can’t NOT write it. When the idea for The Case of the Displaced Detective hit, I wrote 215,000 words inside two months. THEN started on the NEXT story in the series. (Given that most novels in the SF and mystery genres run 80,000-100,000 words, my publisher made me split it into two books. So basically I wrote 3 books in as many months. I didn’t finish The Case of the Cosmological Killer at that point, due to an illness, but it was easily half done. It, too, ended up having to be split into two books.)

What writers have influenced your style and technique?

Mm. I have gotten this question a few times and it’s always very difficult to answer, because SO MANY have been a major influence. And surprisingly for someone who’s known as an SF writer, many, probably most, of them were NOT SF authors.

I would name Arthur Conan Doyle right up there, as well as Ray Bradbury and Isaac Asimov. James Joyce. Edgar Rice Burroughs — interestingly enough, NOT his SF, but his Tarzan books. Charles Dickens. Bram Stoker. H.G. Wells. Mark Twain. Jack London. More recently, Jerry Pournelle, Travis Taylor and Lois McMaster Bujold, I suppose.  I’m fairly well-read for a scientist sort, so I could go on for a long time on this. But I think those are likely my principal influences. I’m probably forgetting someone.

Where would you rank writing on the "Is it an art or it is a science continuum?" Why?

About halfway in between. 50-50. Because I write hard science fiction often combined with mystery, there is a lot of research I do, as much in its own way as if I were writing a research paper. And there are specific forms and formats that must be used. It’s the WAY I put it all together than constitutes the “art” part, I think. Or at least I hope so; I try hard.

Any other upcoming projects you would like to plug?

Well, let’s see. I already mentioned the new Holmes series, first book Sherlock Holmes and the Mummy’s Curse. I’m also working on book 6 of the Displaced Detective series, called Fear in the French Quarter. And book 4 of the Cresperian Saga is in work with a co-author, one of my protegés, Dan Hollifield, titled Heritage. Those are all still in work, so it’ll be awhile before they show up on store shelves, but I’m working as fast as I can!
